These Terms and Conditions govern the use of www.shem.world and purchases made through the website.
By using this website or purchasing a work or product’ you agree to these Terms and Conditions. Nothing in these Terms affects your statutory rights.
1. Use of the Website
You may use this website for personal and lawful purposes only.
We may update the website or these Terms and Conditions from time to time. Changes will apply from the date they are published and will not affect purchases already accepted.
We do not guarantee that the website will always be available’ uninterrupted or free from errors.
2. Artworks and Products
We take reasonable care to present artworks, editions and products accurately.
Colours and appearance may vary slightly because of photography’ lighting and individual screen settings. Handmade works and objects may contain variations that form part of the artist,s process and intention.
Titles’ dimensions’ materials and other relevant details will be displayed on the website or provided directly before an artwork purchase is completed.
All artworks and products are subject to availability.
Nothing in this section limits your rights where an item is faulty’ damaged’ incorrectly supplied or not as described.
3. Artwork Enquiries and Private Sales
Original artworks are generally available by enquiry rather than through the public store.
Where an artwork purchase is agreed’ the buyer may be provided with a private webpage’ payment link or invoice through which to complete the transaction.
The artwork,s title’ dimensions’ materials’ price ‘ delivery arrangements and any specific conditions will be confirmed before purchase.
A private checkout page is intended solely for the buyer to whom it has been provided and must not be shared without permission.
Commissioned’ personalised and bespoke works are created specifically for the individual collector. Once a commission has been confirmed and production has begun’ it cannot be cancelled’ returned or refunded unless otherwise agreed in writing. This does not affect the buyer’s statutory rights where the work is faulty’ damaged or materially not as described.
4. Orders and Payment
Placing an order constitutes an offer to purchase the selected artwork or product.
We will send an email acknowledging the order. A contract is formed when the order is accepted or dispatched.
Payment must be made using a payment method offered at checkout or otherwise agreed for a private artwork sale.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
We may decline or cancel an order before acceptance where:
An item is unavailable.
Payment cannot be authorised.
An obvious pricing or product-description error has occurred.
We reasonably suspect fraud or unauthorised activity.
We cannot deliver to the address provided.
If payment has already been taken for an order we cannot fulfil’ a full refund will be issued.
5. Prices
Prices are displayed in pounds sterling.
Shipping costs and any other applicable charges will be displayed at checkout or agreed before an artwork purchase is completed.
Prices may be changed at any time’ but changes will not affect purchases already accepted.
International buyers may be responsible for import duties’ taxes and customs charges imposed by the destination country. These charges are the buyer’s responsibility unless otherwise agreed in writing.
6. Shipping and Delivery
We aim to process and dispatch orders within 21 calendar days of order confirmation.
Shipping costs will be calculated at checkout or agreed directly for original artworks.
Delivery times are estimates and may vary depending on the destination. Delays may occasionally occur because of carriers, customs or circumstances outside our reasonable control.
If an order is significantly delayed’ please contact us so that we can assist.
Your order remains our responsibility until it is delivered to you or to a person nominated by you to receive it’ except where you independently arrange a carrier not offered by us.
Delivery and installation arrangements for original artworks’ furniture or larger objects may be agreed individually before purchase.
7. Cancellations and Returns
For eligible items purchased online’ UK consumers normally have the right to cancel within 14 days beginning the day after the item is received.
To cancel an eligible purchase’ you must clearly notify us within the cancellation period.
The item must then be returned within 14 days in its original condition’ with any packaging’ tags’ certificates or accompanying materials included where reasonably possible.
Unless the item is faulty’ damaged or incorrectly supplied’ the buyer is responsible for the direct cost of returning it. We recommend using a tracked and appropriately insured service’ particularly for artworks’ editions and limited objects.
You may handle an item only as much as reasonably necessary to establish its nature’ characteristics and condition. We may reduce the refund if unnecessary handling has diminished its value.
The right to cancel does not normally apply to:
Commissioned artworks.
Personalised products.
Bespoke works or objects.
Items made to the buyer,s individual specifications.
Sealed items unsuitable for return for health or hygiene reasons once unsealed.
We do not offer exchanges.
Nothing in this section affects your statutory rights.
8. Refunds
Where a cancellation or return is accepted’ the refund will include the price paid and the cost of standard delivery.
Additional delivery costs resulting from your choice of an enhanced or express service will not normally be refunded.
We may withhold the refund until the returned item is received or you provide satisfactory evidence that it has been sent.
Refunds will be issued to the original payment method within 14 days of receiving the returned item or acceptable evidence of return.
9. Faulty’ Damaged or Incorrect Items
Please inspect your order following delivery.
If an artwork or product arrives faulty’ damaged’ incorrectly supplied or not as described’ contact us promptly with your order information and photographs where appropriate.
We will provide an appropriate repair’ replacement’ price reduction or refund in accordance with your statutory rights.
Nothing in these Terms limits your rights under the Consumer Rights Act 2015.
10. Ownership and Copyright
Purchasing an artwork transfers ownership of the physical artwork only.
Copyright and all other intellectual-property rights remain with SHEM unless expressly transferred through a separate written agreement.
Purchasing an artwork does not grant permission to reproduce’ publish’ commercially exploit’ license or create derivative works from it.
An artwork may not be reproduced for commercial or promotional purposes without prior written permission’ except where otherwise permitted by law.
All artworks’ photographs’ films’ text’ graphics’ logos’ trademarks and other content appearing on this website are owned by or licensed to SHEM.
Website content may not be copied’ reproduced’ modified’ distributed’ commercially exploited or republished without prior written permission.
11. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful’ including liability for:
Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Breach of statutory consumer rights.
Any other liability that cannot legally be excluded.
We are responsible for losses that are a foreseeable result of breaching these Terms or failing to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when an agreement was made or for business losses arising from a purchase made primarily for personal use.
12. Privacy and Cookies
Personal information is handled in accordance with our Privacy Policy.
Cookies and similar technologies are managed through the website’s cookie notice and preference controls.
13. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Consumers living elsewhere may also benefit from mandatory protections under the laws of their country of residence.
The courts of England and Wales will have jurisdiction’ although consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts where applicable.
